And 'now known to all the normal practice to compensate for "just cause" , the costs of litigation in the judgments of opposition to administrative penalties, even when the appeal is allowed. The
"just cause" would be represented by the fact that the citizen is not obliged to be assisted by counsel in these types of proceedings.
But now the art. 92 Code of Civil Procedure was amended, and the second paragraph, provided the compensation is no longer for "just cause" but for "grave and exceptional reasons" .
We'll see if the Justices of the Peace will continue to offset the costs of litigation, frustrating, economically, the sacred right of citizens to make use of a technical defense.
